Please read these Terms of Service ("Terms") carefully before using the Prompt Perfect application ("Service" or "App"), operated by Solo Tandem Bicycle, Inc. ("us", "we", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

Prompt Perfect is an AI-powered assistant integrated into the ChatGPT platform (via Model Context Protocol or similar technologies). It provides tools for prompt rewriting, a personal prompt library, curated "Golden Prompts" templates, and chat rating analysis.

2. Dependency on Host Platform (ChatGPT)

• Acknowledgment of Beta/Primitive Status: You acknowledge that this App operates as a primitive/integration within the ChatGPT ecosystem. Its functionality is strictly dependent on the availability, API stability, and policies of OpenAI.
• No Guarantee: We do not guarantee that the App will function uninterrupted if OpenAI makes changes to the ChatGPT platform, Model Context Protocol, or associated APIs.

3. User Accounts

• Authentication: Access to certain features (like the Library) requires authentication via Google SSO (managed by Firebase). You are responsible for maintaining the security of your login credentials.
• Account Termination: We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

4. User Conduct & Content

• Your Content: You retain ownership of the original prompts you input into the Service.
• License to Us: By using the Service, you grant Solo Tandem Bicycle, Inc. a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your inputs solely for the purpose of providing the Service.
• Sensitive Data Prohibition: You agree NOT to input any sensitive personal information (including but not limited to financial information, payment card numbers, social security numbers, or health information) or proprietary/confidential trade secrets into the Service. You acknowledge that the Service is an AI-powered tool and should not be used as a secure vault for confidential data. Solo Tandem Bicycle, Inc. is not liable for any data leaks resulting from your voluntary submission of sensitive information.
• Prohibited Use: You agree not to use the Service to generate prompts that are illegal, harmful, threatening, or violate OpenAI’s Usage Policies.

5. AI-Generated Outputs & Intellectual Property

• AI Outputs: The "perfected" or "rewritten" prompts generated by the Service are created by Artificial Intelligence (e.g., GPT-4o). You are solely responsible for reviewing and validating these outputs before using them.
• Ownership of Outputs: As between you and us, you own the optimized prompts generated for you by the Service.
• App Content: The "Golden Prompts" templates and the App's underlying code, design, and "Prompt Perfect" branding are the exclusive property of Solo Tandem Bicycle, Inc.

6. Disclaimers

• "As Is" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties of any kind, whether express or implied.
• No Professional Advice: The Service allows for the generation of content using Artificial Intelligence. You acknowledge that the Service is not a substitute for professional advice. You agree not to rely on the Service for legal, medical, financial, or other professional advice. Solo Tandem Bicycle, Inc. disclaims all liability for any actions you take based on the outputs generated by the Service.
• AI Accuracy: AI models can make mistakes. We do not warrant that the rewritten prompts or chat ratings will be accurate, reliable, or error-free. You use the outputs at your own risk.

7. Limitation of Liability

In no event shall Solo Tandem Bicycle, Inc., its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; or (ii) any conduct or content of any third party on the Service.

8. Indemnification

You agree to defend, indemnify, and hold harmless Solo Tandem Bicycle, Inc. and its employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; or b) a breach of these Terms.

9. Dispute Resolution & Arbitration

• Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be determined by binding arbitration in Austin, Texas.
• Class Action Waiver: You and Solo Tandem Bicycle, Inc. agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

10. Force Majeure

We shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation, acts of God, or outages of third-party service providers (including OpenAI and Google Cloud Platform).

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
